Scammy company sending unsolicited mass spam mails
This company is using Mails from hacked databases to send out spammails I'm highly annoyed by this continuous unsolicited spam mails and already got 2 of your domains banned by the gmail abuse team. I'm waiting for your next spam mail in my inbox so I can immediately get you flagged again on your new domain. Edit on the 22.02.2024 as response to your answer: 1. Judging from your practices I highly doubt that those are more than empty claims. Otherwise you wouldn't spam hundreds of thousands of people with your unsolicited mails. 2. As I do not know who your company i definitely could not agree to receive any messages from you. We never had any contact before. This is 100% illegal. In addition you didn't just send me one mail, but an endless number of automated follow-up spam-emails, trying to bait an answer. 3. Another lie. The sitemap you sent to me literally contains just several 404-errors(page not found), as our server blocked your automated crawler attempts. 4. You do not. You sent me an endless amount of unsolicited E-Mails that I obviously did not respond to. But you just kept sending more, trying to bait an answer or unsubscribe-click so you know whether or not the email is actually active, to, judging from your practices, include my email in several of your other unsolicited Spam-Mail-Campaigns for various products... we all know how this works. Edit on the 22.02.2024 : I just fed chatgpt 4 with the situation outlined. .) You are using an email of mine that verifiable is from a database leak. .) You pretend in your email, that there was already a conversation in the past. .) When not responding you continue with an endless amount of automated follow up emails .) Your emails are not as you claimed handcrafted but fully automated, proven by your "handmade" sitemap that contains nothing but errors. The chatgpt4 response: ### Regarding Your Situation: - Use of Hacked Databases: If the company is indeed using emails from hacked databases, this is illegal under virtually all jurisdictions, including but not limited to the CAN-SPAM Act and GDPR. This practice violates the principles of lawful, fair, and transparent processing of personal data. - Automated Follow-Up Emails: Sending automated follow-up emails to individuals who have not engaged with the initial email can be seen as a nuisance and potentially violates the spirit of both the CAN-SPAM Act and GDPR, particularly if there's no easy way to opt out. - Misrepresentation and Misleading Practices: If the company's practices are misleading or deceptive in any way, such as by sending emails that appear to be something they are not or failing to honor opt-out requests promptly, they would be in violation of the CAN-SPAM Act. ### Conclusion: While the company's CEO claims that their practices are legal under the CAN-SPAM Act, the legality might hinge on several factors, including the accuracy of their adherence to the Act's requirements, the origin of their email list, and whether they are also compliant with other relevant laws like the GDPR. If you believe the company is not adhering to these laws, you may consider filing a complaint with the relevant regulatory authority in your jurisdiction (FTC in the US for CAN-SPAM Act violations, or a Data Protection Authority in the EU for GDPR violations Meaning: I'll file a complaint with the DPA in the EU tomorrow and will be looking for a lawyer in the USA to report you to the FTC and look into further claims. I'll also be contacting your alleged business partners like IBM to report your practices. I'd honestly not be surprised if they have never heard of your company, but let's see!
