Jan Szwajnos of Norridge, IL hired us to file a senior freeze exemption on his mothers behalf for an apartment unit. I told him that I can file it as long as the household income is under 65k and she is older than 65 years old. He confirmed these details as being true. On 02/11/2025 I sent him a DocuSign, with am occupancy affidavit and attorney representation form that we needed to sign agreeing to our services, which he signed without hesitation or calling me without any questions, in which we disclosed that the fee for filing is a flat fee of $350 if the application is approved, which it was. We would have not billed him if it was rejected. I am not sure what you mean by billing you "upfront" as we never have and never do with our clients. The United States is a capitalistic economy, meaning that we do not work for free. We sent Jan Szwajnos a bill, that he clearly didn't pay which is when we sent him to our collections attorney.

Hi Shawn, Kacper Staniszewski, Owner & Founder of Kepper Recovery, LLC here, I wanted to address some concerns regarding your recent review and clarify the current situation. At the time of writing your review, you had already signed an agreement with us a whole month prior. As per our standard procedure, we processed your case and disclosed the source of the funds we located for you. We communicated that additional documentation, specifically a notarized Limited Power of Attorney, covering the right to work on your behalf to recover the found funds was needed to continue our work on your behalf. Unfortunately, despite multiple attempts to contact you, we have not received the required notarization. We are closely monitoring your file, and given the lack of response and cooperation, we assume you will not be returning the requested form. If we see that an application is sent out and the funds are successfully recovered from the entity we identified as holding them, we will mail you an invoice for the agreed-upon fee. Please be aware that if this invoice is not paid within 90 days, it will be sent to collections. For your records, I emailed and mailed you the signed Agency Agreement yesterday (08/02/2024), and I will do so again today (08/03/2024), since it seems my previous communication may have been overlooked. We want to ensure you have all the necessary documentation. Regarding your comment about being threatened with "seizing any tax money for the next 20 years," I’d like to clarify this point. At no time did I state that we would seize any tax money for such a period. I believe you may be referring to my explanation that unclaimed funds typically have a statutory expiration period. According to Illinois General Assembly under 765 ILCS 1026, Article 2, titled Presumption of Abandonment, unclaimed funds are presumed abandoned after a certain period of inactivity, typically three years. However, they do not expire until 20 years have passed. After this period, the funds would revert to the holding entity, aligning with standard business protocols/ Illinois law. Please feel free to reach out if you have any further questions or concerns. Kacper Staniszewski (312) 715- 7577 [email protected]
